1. Acceptance of terms
By creating an account or using Selfana, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, don't use the service. We may update these terms; we'll give you 30 days' notice of material changes by email or an in-app banner before they take effect, and continued use after that notice constitutes acceptance.
2. Who we are — and what we are not
Selfana is software that helps a homeowner manage a for-sale-by-owner (FSBO) transaction: generating listing copy, analyzing offers, tracking contingency deadlines, coaching you through state-required disclosure forms, and organizing transaction documents.
Selfana is not a licensed real-estate broker, a licensed real-estate agent, a real-estate attorney or law firm, a mortgage lender, or an investment adviser, and does not offer real-estate, legal, financial, tax, or investment advice in connection with the service. Our AI provides information, not advice. Nothing on the platform creates an attorney–client, broker–client, or fiduciary relationship between you and Selfana.
3. MLS access and the Broker Partner
Federal law and every U.S. state require a licensed broker to submit a listing to a Multiple Listing Service (MLS). Where MLS access is required, Selfana arranges for a licensed real-estate broker in your state (the "Broker Partner") to submit your listing under a Limited Service Listing Agreement.
The Broker Partner — not Selfana — is the licensed entity and the listing agent of record, and only for the limited purpose of submitting your listing to the MLS. The Broker Partner does not represent you in the sale, does not show your home, and does not negotiate on your behalf. Selfana is not a party to your sale. The Broker Partner for your state is disclosed at sign-up and on the About page.
4. Eligibility and account terms
- You must be 18 or older and legally able to sell the property you list.
- Information you provide must be accurate and current.
- You are responsible for keeping your credentials secure. Notify us immediately of any unauthorized access.
- One account per transaction.
5. AI features — information, not advice
Selfana's AI generates listing copy, summarizes and extracts offer terms, tracks deadlines, coaches you through disclosure forms, and produces readiness analysis. All of it is an informational tool — not legal, financial, or real-estate advice — and is not a substitute for a licensed attorney, broker, inspector, appraiser, or accountant.
AI-generated content may be incomplete or wrong. You are responsible for independently verifying any material fact before you rely on it. To keep quality high, Selfana staff may review, pause, or correct AI conversations; this oversight is quality assurance and is not the provision of advice.
6. Your disclosure obligations
You are solely responsible for the truth, accuracy, and completeness of every disclosure you make about your property, as required by your state. Selfana helps you read and complete the disclosure forms your state's regulator publishes; it does not decide, on your behalf, what you must or must not disclose, and it does not interpret whether a particular fact triggers a disclosure obligation.
Review every completed disclosure form with a licensed real-estate attorney or your broker before you sign it or deliver it to a buyer. Inaccurate or incomplete property disclosures are your legal responsibility, not Selfana's.
If you use Selfana's photo-based readiness analysis, any condition it surfaces from your photos is presented to you as a question for you to confirm — never as an established finding — is visible only to you, and can be deleted by you with your property data. You decide what, if anything, to disclose.
7. Listing Readiness Analysis
Selfana's Listing Readiness Analysis is an informational product that assesses your property's presentation and, in the Comp Comparison Builder, gives you a tool to build your own comparable-sales comparison. You choose the comps and enter every adjustment; the software does the arithmetic and shows your own model's range. It is not an appraisal, not a CMA, not an automated valuation model, not a broker price opinion, and Selfana does not set or recommend a price for your home. Comparable-home inputs and adjustments are your own. Verify any value-sensitive decision with a licensed appraiser or broker.
8. Fees, billing, and AI usage
The platform listing fee is a flat $299 per listing and bundles MLS submission, in-app tools, and AI coaching up to an included usage budget. Listing Readiness Analysis runs are billed separately ($29 / $49). A premium AI coaching upgrade is available at $49/month.
Each listing includes a generous AI-usage budget. Heavy use beyond that budget may route non-critical replies to a faster model or prompt you to upgrade to the unlimited premium tier; sellers within the budget never encounter this. Payments are processed by Stripe; we store only a Stripe customer reference.
9. Refunds and cancellation
You may cancel at any time. We don't issue refunds for partial months of a subscription. If your transaction is in progress when your account ends, we will provide a data export within 30 days so you can continue the transaction independently.
10. Third-party services and referrals
Selfana may surface third-party providers. These relationships are disclosed where they exist:
- Title and escrow. Where we receive compensation in connection with a title or escrow provider, it is through a marketing-services arrangement structured to comply with the Real Estate Settlement Procedures Act (RESPA) — not a fee paid per referral.
- Commodity vendors (cleaners, movers, handymen, sign installers). Some links are affiliate links for which we may earn a small fee, disclosed at the point of the link in accordance with FTC guidance. We never take affiliate or referral compensation for attorneys or title/escrow.
All third-party providers are independent. Selfana does not warrant their services and is not responsible for their acts or omissions.
11. Buyer agents and invited users
If you access Selfana as a buyer's agent or as a buyer invited by a seller, these terms apply to you as well. Selfana does not represent you. Any buyer-agent compensation shown in the platform is set by the seller, not by Selfana, and is between you and the seller.
12. Electronic records and signatures
By using Selfana you consent to transact electronically and to receive records, disclosures, and notices in electronic form under the federal ESIGN Act and applicable state Uniform Electronic Transactions Acts. Documents you sign through Selfana's electronic-signature flow are intended to be legally binding. You may withdraw consent by closing your account, which may prevent you from using features that require electronic records.
13. Your content and our license
You retain ownership of the listing details, documents, and other content you provide. You grant Selfana a license to host, process, and display that content as needed to operate the service for you. We do not sell your personal information, and our AI processors are contractually prohibited from training their models on your data by default. See our Privacy Policy for details.
14. Acceptable use
You agree to:
- Provide accurate and complete property disclosures as required by your state.
- Comply with all applicable laws, including real-estate disclosure statutes, the Fair Housing Act and state fair-housing rules, and transfer requirements. You are responsible for the content of your listing, including any fair-housing compliance.
- Not use the platform to facilitate fraudulent transactions.
- Not scrape the platform, extract or reverse-engineer Selfana's AI models, or use platform data to train any machine-learning or AI system without our written consent.
15. Disclaimer of warranties
Selfana is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy of AI-generated content, accuracy of third-party or market data, and any guarantee of a particular transaction outcome. AI-generated listing copy, offer summaries, readiness analysis, and coaching are informational — not legal or financial advice. Verify all material facts independently before relying on them.
16. Limitation of liability
To the maximum extent permitted by law, Selfana's aggregate liability for any claim arising from or relating to the service is limited to the greater of (a) the total fees you paid to Selfana in the 12 months before the claim or (b) one hundred dollars ($100). We are not liable for indirect, consequential, incidental, special, or punitive damages, including lost profits or the loss or delay of a real-estate transaction.
17. Indemnification
You agree to indemnify and hold Selfana harmless from claims arising from your use of the platform, your property disclosures, the content of your listing (including any fair-housing violation), or your breach of these terms.
18. Termination
You may cancel at any time. We may suspend or terminate accounts for violations of these terms. If your transaction is in progress at termination, we will provide a data export within 30 days so you can continue independently. No refunds are issued for partial months.
19. Dispute resolution
These terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules [governing state — counsel to confirm]. Except for claims you may bring in small-claims court, any dispute will be resolved by binding, individual arbitration under the rules of the American Arbitration Association. You and Selfana waive the right to a jury trial and the right to participate in a class or representative action.
Opt-out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these terms. Time limit. Any claim must be filed within one year after it arises, or it is permanently barred, to the extent permitted by law.
